TERMS OF SERVICE
Effective Date: August 28, 2026
Last Updated: October 13, 2026
Welcome to Supkowski Sports Medicine. These Terms of Service (“Terms”) govern your access to and use of the Supkowski Sports Medicine website, digital products, performance coaching, consultations, educational materials, and related services.
By accessing this website, purchasing a product, or using our services, you agree to these Terms.
1. SERVICES
Supkowski Sports Medicine provides services that may include performance coaching, strength and conditioning programming, consultations, educational resources, digital training programs, and related performance services. Clinical services may also be provided by James Supkowski through or in affiliation with a separate licensed healthcare practice. Clinical services provided through another healthcare practice are subject to that practice’s applicable policies, procedures, consent requirements, privacy practices, and clinical documentation.
2. DIGITAL PRODUCTS
Digital products, including training programs, guides, educational materials, and downloadable resources, are provided for the purchaser’s personal use only. Purchasing a digital product does not transfer ownership of the underlying intellectual property. You may not reproduce, distribute, share, sell, publish, upload, or otherwise make purchased materials available to another person without written permission from Supkowski Sports Medicine.
3. PERFORMANCE COACHING AND CONSULTATIONS
Performance coaching and consultations may include individualized training recommendations, exercise programming, education, performance guidance, and related services as described at the time of purchase. Results vary between individuals, and Supkowski Sports Medicine does not guarantee any particular strength, performance, physical, financial, or other outcome.
4. PAYMENTS AND BILLING
Prices are disclosed at the time of purchase and are subject to change. Payment is required before services are rendered unless otherwise agreed upon in writing.
Supkowski Sports Medicine accepts approved electronic payment methods, including third-party payment processors and Zelle. Payments must be verified before services begin.
Prepaid clinical packages and integrated care bundles must be paid in full before services commence unless an alternative payment arrangement has been established.
Recurring performance coaching subscriptions may be billed monthly until canceled in accordance with the terms disclosed at enrollment. Any recurring billing arrangements will be disclosed and authorized before charges begin.
Purchasing a clinical package does not guarantee a specific treatment outcome or require the patient to undergo services that are no longer clinically appropriate.
5. REFUNDS AND CANCELLATIONS
General Refund Policy: Purchases are generally non-refundable once the applicable product has been delivered or service has been completed, except where otherwise required by applicable law.
Digital Products: Digital programs and educational materials are considered delivered once access has been provided. Refunds are subject to applicable law.
Completed Services: Completed chiropractic evaluations, follow-up appointments, rehabilitation sessions, consultations, and coaching services are generally non-refundable, subject to applicable law.
Clinical Appointment Cancellations: Appointments must be canceled or rescheduled at least 24 hours in advance. Late cancellations and missed appointments may incur a fee of $75 for initial evaluations, $50 for follow-up visits, or $25 for standalone soft tissue therapy appointments, where permitted by law and disclosed before booking.
Prepaid Chiropractic & Rehabilitation Packages: Supkowski Sports Medicine offers prepaid packages containing 4, 8, or 12 clinical visits. Each package includes the specified number of appointments, subject to clinical appropriateness and scheduling availability.
If a patient elects to discontinue care, or further treatment is no longer clinically indicated, unused prepaid services will be addressed under the applicable written package agreement and California law. Refunds, when required, will be calculated using the agreed-upon valuation of services already provided and any applicable lawful charges.
Integrated Care Bundles: Packages combining chiropractic and rehabilitation services with performance coaching are subject to the same clinical refund provisions. Coaching services will be accounted for separately according to the duration of coaching already provided and the applicable written agreement.
Package Expiration: All prepaid chiropractic, rehabilitation, and integrated care packages expire 90 calendar days from the date of purchase. All included appointments must be scheduled and completed within this period. Unused visits do not automatically extend beyond the expiration date. Packages are nontransferable, and refunds will not be issued after the 90-day expiration period, except where required by applicable California law. Any exceptions or extensions are subject to approval by Supkowski Sports Medicine.
Recurring Coaching: Cancellation of a recurring coaching subscription will stop future charges in accordance with the terms disclosed at enrollment. Refunds for unused prepaid coaching services will be handled according to the applicable agreement and law.
Separate Healthcare Practices: Services provided through an independent or affiliated healthcare practice may be subject to that practice’s applicable financial and cancellation policies, as disclosed to the patient.
6. HEALTH AND EXERCISE DISCLAIMER
Participation in exercise, strength training, conditioning, and physical activity involves inherent risks, including the possibility of injury. Information provided through this website, digital products, performance coaching, educational content, or other non-clinical services is not intended to replace individualized medical evaluation, diagnosis, or treatment when such care is appropriate. You are responsible for determining whether participation in any exercise or training activity is appropriate for you and for seeking appropriate healthcare evaluation when necessary.
7. CLINICAL SERVICES AND PROVIDER-PATIENT RELATIONSHIPS
General use of this website, viewing educational content, purchasing a digital product, or submitting a general contact or coaching form does not by itself establish a healthcare provider-patient relationship. A provider-patient relationship may be established when an individual formally receives clinical care through the appropriate clinical practice, including completion of any required intake, consent, examination, and other applicable procedures. Clinical services provided by James Supkowski through or in affiliation with another healthcare practice are subject to the policies, privacy practices, documentation, informed-consent procedures, and other requirements of that practice. Information provided through Supkowski Sports Medicine’s general website, social media, digital products, and non-clinical educational content should not be interpreted as individualized diagnosis or treatment unless expressly provided within an established clinical relationship.
8. ASSUMPTION OF RISK
By voluntarily participating in exercise or implementing information provided through our products or services, you acknowledge that physical activity carries inherent risks. You accept responsibility for your participation and agree to stop an activity and seek appropriate assistance if you experience concerning symptoms, injury, or another condition requiring evaluation.
9. INTELLECTUAL PROPERTY
Unless otherwise stated, website content, written materials, graphics, branding, program materials, educational resources, photographs, videos, and other original content provided by Supkowski Sports Medicine are owned by or licensed to Supkowski Sports Medicine and are protected by applicable intellectual-property laws. Nothing in these Terms grants you permission to use Supkowski Sports Medicine trademarks, branding, logos, or copyrighted materials for commercial purposes without written authorization.
10. ACCEPTABLE USE
You agree not to misuse the website or services, attempt to gain unauthorized access to website systems, interfere with website functionality, use our materials for unlawful purposes, impersonate another person, or redistribute purchased materials without authorization.
11. THIRD-PARTY SERVICES
Our website may integrate or link to third-party services for payment processing, scheduling, email, analytics, social media, or other business functions. Supkowski Sports Medicine is not responsible for the availability, content, security, or independent practices of third-party services.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Supkowski Sports Medicine and its owners, personnel, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website, products, or services. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
13. CHANGES TO THESE TERMS
We may modify these Terms periodically to reflect changes in our services, business practices, or applicable requirements. The “Last Updated” date will be revised when changes are made. Continued use of the website or services following an update constitutes acceptance of the revised Terms to the extent permitted by law.
14. GOVERNING LAW
